The buying process in Spain, step by step

Buying a home in Spain follows a very defined structure. Done in order and with the right guidance, there are no surprises. This is how we guide you:

1. Search and selectionWe define the area, property type and a realistic budget, taxes and costs included.
2. Legal verification (due diligence)Land Registry extract, charges, mortgages or seizures, property tax, community fees, habitation certificate and energy certificate.
3. NIE and bank accountEssential for signing. They can be arranged without you travelling; the NIE usually takes 2 to 4 weeks.
4. Reservation contractTakes the property off the market while the paperwork or financing is prepared.
5. Deposit contract (arras)A pre-deed agreement, usually with a 10% deposit. Legal review is advisable here to protect your interests.
6. Financing (if you need it)Non-residents usually need a 30-40% down payment. We advise you and coordinate with the banks.
7. Signing before the notaryThe public deed is signed. If you can't travel, it's resolved with an apostilled power of attorney.
8. Registration and keysRegistration of the property in your name and handover of keys. If you're a non-resident, we advise you on your subsequent tax obligations.

Common mistakes we help you avoid

• Signing the deposit contract without legal review and being bound by unfavourable terms.
• Buying without checking the Land Registry extract: the property may carry mortgages, seizures or community debts that you would take on.
• Not calculating the real tax cost: the price plus an extra 10-12% is what you really pay, and many fall short at signing.
• Confusing the temporary NIE with the permanent one (the temporary one expires after 3 months).
• As a non-resident, not appointing a tax representative after the purchase.

What to budget on top of the price

As a rule of thumb, allow an extra 10% to 13% on top of the price: transfer tax (resale) or VAT + stamp duty (new build), notary, registry and administration. Before signing, we prepare the exact calculation of your transaction with you.
