2. Data we collect
Data provided through the contact form (name, phone, email, message), WhatsApp, direct email and website browsing.
2.1. What we collect and when
- Contact, appointment, advice, alert and brochure forms: name, phone, email, language, property of interest and the message you write.
- Property valuation: the property details you enter (address or cadastral reference, surface area, type, condition and features) and your contact details so we can send you the report.
- Browsing: if you arrive from a link in one of our emails, we record which property pages you view so that we can advise you with knowledge of what you are looking for. This happens only if you open one of those links; anonymous browsing is not linked to any person.
- Cookies and analytics: only if you accept them. See the cookie policy.
3. Purposes of processing
- Answering your enquiry and sending you information about the properties you are interested in.
- Arranging viewings and appointments, in person, by phone or by video call.
- Preparing and sending you the indicative valuation of the property you tell us about.
- Sending you the PDF brochure of a specific property, when you request it.
- Sending you alerts about properties matching your search, if you have subscribed.
- Commercial follow-up of your enquiry, including automated reminder emails, until the transaction closes or you ask us to stop writing.
- Measuring use of the website statistically, only if you accept analytics cookies.
- Meeting our legal, tax and accounting obligations.
4. Legal basis
- Purposes 1 to 4 (enquiry, appointments, valuation and brochure): your consent when submitting the form and, where applicable, pre-contractual steps taken at your request (Art. 6(1)(a) and 6(1)(b) GDPR).
- Purpose 5 (alerts): your consent, which you may withdraw at any time from the unsubscribe link in each email (Art. 6(1)(a) GDPR).
- Purpose 6 (commercial follow-up): our legitimate interest in properly attending to someone who contacted us on their own initiative and not leaving their enquiry unanswered (Art. 6(1)(f) GDPR). You may object at any time, without giving reasons, and we will stop writing to you.
- Purpose 7 (analytics): solely your consent (Art. 6(1)(a) GDPR). Without it, no analytics cookie is installed.
- Purpose 8 (legal obligations): compliance with a legal obligation (Art. 6(1)(c) GDPR).
5. User rights
You may at any time exercise your rights of access, rectification, erasure, restriction of processing, objection and portability, and withdraw any consent you have given, without affecting the lawfulness of processing carried out before withdrawal.
To do so, write to info@tatjanawellem.com stating the right you wish to exercise. We may ask you to prove your identity if we cannot reliably identify you. We will reply within one month of your request.
If you believe we have not handled your request properly, you may complain to the Spanish Data Protection Agency (www.aepd.es), although we would be grateful if you raised it with us first.
6. Data retention
- Enquiries that do not lead to a transaction: your data is automatically anonymised 3 years after the last contact. It is not deleted but de-personalised, so that it is no longer linked to you.
- Completed transactions: contractual, tax and accounting records are kept for the periods required by law (4 years under Spanish tax rules and 6 years under the Commercial Code), outside this website.
- Cookie consent: one year, or until you change it.
You may request earlier deletion at any time by writing to info@tatjanawellem.com, except for what we are legally required to keep.
7. Third parties involved
- Web hosting: Webempresa (Spain).
- Email delivery: Arsys (Spain).
- Analytics: Google Analytics 4, only with your consent.
- Appointment scheduling: Calendly, if you use it.
- Maps: Carto and OpenStreetMap, to show property locations.
- Instagram: to display posts on the site.
- Currency conversion: Frankfurter, an exchange-rate service that receives no personal data.
- Brochure translation: an artificial-intelligence provider (OpenAI or Anthropic). Only the property description is sent; never your personal data.
- Public administration: the Spanish Cadastre and the National Statistics Institute (INE), consulted for valuations. Both are Spanish public bodies.
International transfers. Providers established in Spain or the European Union (Webempresa, Arsys) involve no transfer at all. Google, Calendly and the translation provider are established in the United States: the transfer relies on the EU-US Data Privacy Framework adequacy decision (Implementing Decision (EU) 2023/1795) where the provider is certified, and on the European Commission's standard contractual clauses otherwise. The Cadastre and the INE are Spanish public bodies and involve no transfer.
8. How to withdraw your consent
You can change or withdraw your cookie consent at any time from the “Cookie preferences” link in the footer. The change takes effect immediately: if you withdraw analytics consent, the corresponding cookies are removed from your browser there and then. For any other processing, write to info@tatjanawellem.com.
9. Are you required to provide your data?
No. Providing your data is voluntary. However, the fields marked as required in each form are the minimum we need in order to assist you: if you do not provide them, we will not be able to answer your enquiry, arrange the viewing or send you the valuation or brochure. No other consequence will follow.
10. Automated decision-making
Property valuations are calculated automatically from the data you enter and market references for the area. It is not an official appraisal, nor a decision producing legal effects concerning you: it is an indicative estimate that binds neither party and can always be checked against a professional valuation. We do not carry out profiling with legal effects.
11. Minors and security
This website is aimed at adults. We do not knowingly collect data from children under 14; if we detect that such data has been provided, we will delete it. We apply technical and organisational measures to protect your data, including encrypted communications (HTTPS), access control to the content manager, backups and automatic deletion of data once the retention period has elapsed.
